Welcome to ThreatModeler Academy! We are excited to have you on your learning journey. These Terms of Service ("Terms") are a legally binding agreement governing your use of our platform.
To make it easier for you, here are some of the most important points:
- Free Service: The Academy is currently provided free of charge. We reserve the right to introduce fees for certain features or courses in the future, but we will notify you in advance.
- Your License: We grant you a limited license to use our courses for personal, educational purposes. You cannot resell or publicly share our content.
- Your Account: You are responsible for your account's security and for all activities that happen under it.
- Disclaimer: Our courses are for educational purposes and do not constitute professional advice. The Service is provided "as is."
- Dispute Resolution: Most disputes will be resolved through binding arbitration.
By creating an account or using our Services, you agree to these full Terms and our
Privacy Policy. Please read them carefully.
- Eligibility: You must be at least 18 years old to use the Services.
- Account Information: You agree to provide accurate and complete information when creating your account and to keep this information updated.
- Account Security: You are responsible for safeguarding your password and for all activities under your account. You must notify us immediately at academy@iriusrisk.com or academy@threatmodeler.com of any unauthorized use.
- Corporate Users: If your access is provided by your employer ("Corporate Customer"), your use is also subject to our agreement with that Corporate Customer.
Subject to your compliance with these Terms, ThreatModeler grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the content and Services for your personal, internal, non-commercial educational purposes.
You are joining a community of professionals. You agree to act with integrity and respect. You will not:
- Violate Academic Integrity: Do not cheat on exams, plagiarize content, or share answers to quizzes or assignments.
- Infringe on Intellectual Property: Do not copy, reproduce, distribute, resell, or publicly display any part of the Services or its content.
- Engage in Unlawful or Harmful Behavior: Do not submit content that is unlawful, defamatory, harassing, or abusive. Do not use the Services for any illegal activity.
- Disrupt the Services: Do not interfere with the platform's operation, use automated means like scrapers to access it, or attempt to discover its source code.
- Share Your Account: Your account is for your use only. Sharing your credentials is a violation of these Terms.
We reserve the right to suspend or terminate your account for any violation of this Code of Conduct.
ThreatModeler may offer certificates of completion ("Certificates") for certain courses.
- Nature of Certificates: These Certificates demonstrate that you have successfully completed a course. They are not academic credits and do not confer any formal accreditation.
- Use and Revocation: You may share your Certificates on professional platforms. You agree not to misrepresent their value. ThreatModeler reserves the right to revoke a Certificate if it was earned in violation of these Terms, including the Student Code of Conduct.
The Services provided through ThreatModeler Academy are currently offered free of charge. ThreatModeler reserves the right, at its sole discretion, to introduce fees for certain features, courses, or to transition the platform to a subscription-based model in the future. We will provide you with reasonable advance notice of any such changes and the applicable fees, at which point you may choose to accept the new terms or discontinue your use of the Services.
- User Content: If the Services allow you to submit content, such as through assignments or exercises ("User Content"), you retain ownership of it. By submitting, you grant ThreatModeler a worldwide, royalty-free license to use, host, and review such content for the sole purpose of evaluating your progress and operating the Service. Public interaction features like forums or chat are currently disabled on the platform.
- Feedback: If you provide us with any feedback, ideas, or suggestions for improving the Services ("Feedback"), you grant ThreatModeler an unlimited, irrevocable, perpetual, royalty-free license to use and implement that Feedback for any purpose without any obligation to you.
- Termination by You: You may terminate your account at any time.
- Termination by Us: We may suspend or terminate your account and access to the Services, with or without notice, for any breach of these Terms, including inactivity or violation of the Code of Conduct. We have no liability for any such termination. The provisions of these Terms that by their nature should survive termination (including Intellectual Property, Disclaimers, Limitation of Liability, and Dispute Resolution) will survive.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED. THREATMODELER EXPLICITLY DISCLAIMS ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE MAKE NO WARRANTY THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR AVAILABLE AT ALL TIMES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THREATMODELER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE SERVICES. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).
You agree to defend, indemnify, and hold harmless ThreatModeler and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Services, or your violation of these Terms.
- Governing Law: These Terms are governed by the laws of the State of New Jersey, USA.
- Arbitration: You agree to resolve any dispute relating to these Terms or the Services through final and binding arbitration administered by the American Arbitration Association (AAA), rather than in court.
- Opt-Out of Arbitration: You can decline this arbitration agreement by emailing us at legal@threatmodeler.com within 30 days of first accepting these Terms.
- Changes to Terms: We may modify these Terms at any time. We will post the revised Terms and update the "Last Updated" date. For material changes, we will use commercially reasonable efforts to provide a more prominent notice. Your continued use of the Services after such changes constitutes your acceptance of the new Terms.
- Entire Agreement: These Terms, our Privacy Policy, and our Cookie Policy constitute the entire agreement between you and ThreatModeler.
- Severability: If any provision is deemed invalid, the remaining provisions will remain in full effect.
